These Terms and Conditions apply to the sale of digital recipe eBooks and related downloadable content (“eBooks”) by Culinariva (“we”, “us”, “our”) via www.culinariva.com (the “Website”).
By purchasing an eBook from our Website, you agree to be legally bound by these Terms.

If you are purchasing as a consumer, nothing in these Terms affects your statutory rights under UK law.
2. Products
We sell downloadable digital recipe eBooks in PDF or similar electronic format.
All purchases are for digital content only. No physical product will be shipped.
3. Ordering & Contract Formation
When you place an order, you will receive an order confirmation email.
A legally binding contract is formed when:
- payment has been successfully processed; and
- we confirm that your eBook is available for download.
We reserve the right to refuse or cancel an order if necessary (for example, if payment fails).
4. Pricing & Payment
All prices are shown in GBP (£) unless otherwise stated.
Payment must be made in full before access to the eBook is provided.
We reserve the right to change pricing at any time, but changes will not affect confirmed purchases.
5. Delivery
eBooks are delivered electronically via:
- a download link provided on the confirmation page; and/or
- an email sent to the address supplied at checkout.
Delivery is deemed complete when the download link is made available.
It is your responsibility to ensure that your email address is correct and that you have suitable software to access PDF files.
6. Licence & Intellectual Property
All eBooks are protected by copyright and intellectual property laws.
When you purchase an eBook, you are granted a non-exclusive, non-transferable, non-commercial licence to use the eBook for personal use only.
You may not:
- resell, share, or redistribute the eBook
- upload it to public websites or file-sharing platforms
- reproduce it for commercial purposes
- modify it and present it as your own work
- use the recipes in a commercial product or publication without written permission
Ownership of all intellectual property rights remains with Culinariva.
7. 14-Day No-Questions-Asked Refund Policy
We offer a voluntary 14-day money-back guarantee.
If you are not satisfied with your purchase, you may request a full refund within 14 days of purchase by emailing hello@culinariva.com.
You do not need to provide a reason.
Refunds will be processed within 14 days of approval using the original payment method.
This policy is offered in addition to your statutory rights under UK law.
We reserve the right to refuse refunds in cases of clear abuse of this policy (for example, repeated refund requests after downloading multiple products).
8. Statutory Digital Content Rights
Under the Consumer Rights Act 2015, digital content must be:
- of satisfactory quality
- fit for purpose
- as described
If your eBook is faulty or not as described, you may be entitled to a repair, replacement, or refund in accordance with UK law.
9. Cooling-Off Rights
Under the Consumer Contracts Regulations 2013, consumers generally have a 14-day right to cancel digital content purchases.
However, by purchasing and downloading your eBook immediately, you:
- expressly consent to immediate delivery of digital content; and
- acknowledge that you lose your statutory right to cancel once the download begins.
This does not affect your rights in relation to faulty digital content.
10. Disclaimer
Our recipes are provided for informational purposes only.
Results may vary depending on:
- ingredients used
- oven performance
- kitchen equipment
- personal skill level
You are responsible for:
- checking for allergies and dietary requirements
- ensuring food safety, hygiene practices and cross-contamination risks
- adjusting recipes as necessary
We do not guarantee specific baking results.
11. Limitation of Liability
Nothing in these Terms excludes liability for:
- death or personal injury caused by our negligence
- fraud or fraudulent misrepresentation
- any liability that cannot legally be excluded
To the fullest extent permitted by law, we are not liable for any accidents or injuries occurring in the kitchen while following our recipes.
To the fullest extent permitted by law, we are not liable for:
- indirect or consequential loss
- loss of business or profit
- data loss
- technical interruptions outside our control
Our total liability shall not exceed the amount paid for the eBook.

13. Governing Law
These Terms are governed by Scots Law. Any disputes shall be subject to the exclusive jurisdiction of the Scottish Courts.
14. Alternative Dispute Resolution
In the unlikely event that a dispute cannot be resolved directly with us, you may refer the matter to an alternative dispute resolution (ADR) scheme. We are not obligated to use ADR but you can find a list of approved ADR providers at https://www.gov.uk/find-ombudsman. You may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr (note: primarily for EU-based customers).
